Texas Criminal Penalties

The following table displays the range of Texas criminal penalties discussed in Chapter 12 of the Texas Penal Code.  Penalties are listed starting at the top from greatest to least.  A full text of Chapter 12 of the Texas Penal Code can be viewed by visiting the following link:   http://www.statutes.legis.state.tx.us/Docs/PE/htm/PE.12.htm

     
1 Capital Felony Life in prison or the possibility of being sentenced to death (death penalty)
     
2 First Degree Felony Life in prison or 5 to 99 years in prison with a possible fine not exceeding $10,000
     
3 Second Degree Felony 2 to 20 years in prison with a possible fine not exceeding $10,000
     
4 Third Degree Felony 2 to 10 years in prison with a possible fine not exceeding $10,000
     
5 State Jail Felony 180 days to 2 years in prison with a possible fine not exceeding $10,000
     
6 Class A Misdemeanor 1 year or less in prison and/or a possible fine not exceeding $4,000
     
7 Class B Misdemeanor 180 days in prison and/or a possible fine not exceeding $2,000
     
8 Class C Misdemeanor Fine of not more than $500.  You can not go to prison for a Class C Misdemeanor.
